Making A Claim

To make a successful claim for compensation the law requires you to prove:

  • That the standard of care you received fell below that of a reasonably competent health care professional in the relevant area of medicine, and You have suffered a physical or mental injury as a direct result of that action or inaction.

  • It is important to note that you cannot claim compensation just because someone has done something wrong, you will need to prove both negligence and causation. You will have to prove that, that person has caused you an injury.
